1. Agreement
These Terms of Service ("Terms") form a binding agreement between you and Anchor ("Anchor," "we," "us") governing your use of the Anchor app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who Can Use Anchor
You must be at least 13 years old to create an account. Marketplace features (posting listings, making offers, exchanging offer messages, leaving ratings) and the Float Plan feature (filing a plan and designating an emergency contact) are available only to users 18 and older. You must be legally able to enter into this agreement in your jurisdiction. You agree to comply with all local, state, and federal laws that apply to your boating, paddling, or water-sport activity, including registration, licensing, and safety requirements.
3. Your Account
- Provide a working email address and keep your login information confidential.
- You are responsible for activity that takes place under your account.
- Choose a username that is not impersonating, offensive, or infringing on another's rights.
- Notify us promptly if you suspect unauthorized access.
- You can delete your account at any time from Account Settings.
4. Your Content
"Your Content" means anything you create through the Service — posts, comments (including photos and videos attached to comments), boat details and photos, marketplace listings, offer messages, group posts, polls, ratings, and similar material. You keep ownership of Your Content. By posting, you grant Anchor a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content as needed to operate and improve the Service. This license ends when you delete Your Content, except for copies retained in routine backups for a limited time or where other users have already interacted with it (for example, a comment thread) in which case we may anonymize it.
Maintenance logs, upgrade logs, trip logs, Float Plans, registration reminders, and pins you mark private are private records — visible only to you (and, in the case of private pins, to the specific friends you choose to share each pin with). We host them on your behalf and do not display them publicly.
You represent that Your Content is yours to post, does not infringe anyone's rights, and does not violate any law or these Terms.
5. Community Rules
When using Anchor, you agree not to:
- Harass, threaten, defame, or discriminate against other users.
- Post content that is sexual, violent, hateful, or otherwise designed to harm.
- Impersonate another person or misrepresent your affiliation with any person or organization.
- Post spam, chain messages, or repeatedly promote the same off-platform content.
- Share another person's private information without their consent.
- Post content that infringes copyright, trademark, or other intellectual property rights.
- Upload malware, exploit vulnerabilities, scrape the Service, or try to bypass rate limits or access controls.
- Use the Service to sell illegal, stolen, counterfeit, recalled, or restricted items.
- Use automated systems (bots, scripts) to interact with the Service without our written permission.
6. Marketplace
Anchor's marketplace lets users list boating parts, accessories, and related gear and exchange offers. Anchor is a venue — we do not process payments, hold funds in escrow, verify listings, inspect items, arrange shipping, or guarantee that any transaction will complete. Buyers and sellers are solely responsible for:
- Accurately describing items, including condition, defects, and any compliance issues.
- Agreeing on price, payment method, pickup or shipping, and returns.
- Paying any applicable taxes, duties, and fees.
- Complying with laws that apply to the sale of boat parts, safety equipment, engines, or other regulated items.
You agree that Anchor is not a party to any transaction between users and is not responsible for disputes, losses, damages, or misrepresentations arising from marketplace activity. Use caution: meet in safe public places, inspect items before paying, and use payment methods that offer you recourse.
7. Float Plans, Marine Conditions, and Safety Features
Anchor includes optional safety features — live marine conditions, the green/yellow/red conditions rating, weather and tide displays, and Float Plans with an emergency-contact SMS alert. These features are informational community tools, not a substitute for professional weather services, official Coast Guard float plans, or your own preparation, judgement, and safety practices on the water.
- Conditions data: the wind, wave, tide, water temperature, alert, and other readings shown on waterway pages are sourced from public government APIs (NWS, NOAA, USGS) and may be delayed, incomplete, or wrong. We make no warranty as to accuracy or timeliness. Always cross-check with authoritative sources before launching.
- Stoplight rating: the green/yellow/red Go-To-Go indicator is a simple rule-of-thumb summary, not a marine-weather forecast. It does not consider your craft, your experience, your route, or local hazards.
- Float Plans: filing a Float Plan in Anchor is not the same as filing a float plan with the U.S. Coast Guard or any other authority. It is a convenience tool that triggers an SMS to the emergency contact you designate if you do not check back in by your stated return time. For serious or remote trips, file with the Coast Guard or a local equivalent in addition to using Anchor.
- Emergency-contact consent: when you designate someone as your emergency contact, you confirm that (a) you have permission from that person to share their phone number with Anchor for the purpose of an overdue-alert SMS, and (b) they have consented to receive that SMS. The SMS is transactional — sent only when your stated return time passes without a check-in — and is not used for any other purpose.
- SMS delivery is not guaranteed.SMS depends on Twilio and your contact's carrier and may be delayed, undelivered, filtered, or fail entirely. Standard carrier message rates may apply to the recipient. Do not rely on the SMS as your sole safety mechanism.
- You remain responsible for safety.You are responsible for your own safety and the safety of passengers, crew, and others on the water — including carrying required equipment, monitoring real-time weather, knowing your craft's limits, and complying with the law. Nothing in Anchor relieves you of those duties.
8. Groups, Polls, and Interactions
Some features (groups, polls, group posts) let you associate with other users. Group owners may approve or decline membership for private groups and may remove content or members who break group rules or these Terms. Anchor may also remove group content at its discretion if it violates these Terms.
9. Reports and Moderation
You can report posts, comments, listings, groups, and other users through the in-app report tool. We review reports and may remove content, restrict features, or suspend or terminate accounts at our discretion. Reports are confidential — we don't reveal the reporter's identity to the user being reported. Submitting false or harassing reports is itself a violation of these Terms.
10. No Professional Advice; Boating Safely
Content on Anchor — including maintenance tips, upgrade recommendations, waterway descriptions, marine conditions, Float Plan alerts, and posts from other users — is provided for informational and community purposes only. It is not professional, legal, mechanical, navigational, weather, or safety advice. Always verify waterway conditions, weather, regulations, and equipment requirements through authoritative sources before you go out. You are responsible for your own safety and the safety of passengers and others on the water.
11. Third-Party Services
The Service uses third-party providers for hosting, authentication, database storage, map rendering, SMS delivery (Twilio), transactional email (Resend), bot-protection (hCaptcha), error tracking, analytics, and push delivery (all described in our Privacy Policy). Those providers have their own terms and privacy policies. Anchor is not responsible for the acts or omissions of third-party providers, and outages or errors on their side may affect availability of the Service.
12. Suspension and Termination
We may remove content, limit features, or suspend or terminate accounts that violate these Terms, put other users at risk, or expose Anchor to legal liability. Where practical we will give notice, but we may act immediately in urgent cases. Suspended users are signed out and shown an explanation on the login screen. You may stop using the Service and delete your account at any time.
13. Changes to the Service; Paid Features
The Service is under active development. Features may change, be added, or be removed. We may set reasonable limits on usage to protect the Service (for example, storage, listing counts, or request-rate limits).
Anchor is free to use today. We reserve the right to introduce optional paid features or a premium membership tier in the future. If we do, we will (a) describe the paid features and price clearly before you opt in, (b) preserve the free features you rely on today wherever practical, and (c) honor any founding-member commitments we have publicly made on the marketing site.
14. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. We do not warrant that any information on the Service is accurate, complete, or current.
15. Limitation of Liability
To the maximum extent permitted by law, Anchor and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, or personal injury, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to the Service will not exceed one hundred U.S. dollars (US$100).
16. Indemnification
You agree to defend, indemnify, and hold harmless Anchor from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. You and Anchor agree to resolve any dispute arising out of or relating to the Service in the state or federal courts located in Delaware and consent to the personal jurisdiction of those courts. Nothing in this section prevents either party from seeking injunctive relief in any appropriate jurisdiction.
18. Changes to These Terms
We may update these Terms from time to time. When we make a material change, we will update the "Last Updated" date above and notify you in-app or by email before the change takes effect. Continued use of the Service after the effective date of the updated Terms means you accept them.
